Welcome to Smahchills. These Terms and Conditions govern your use of our website and purchases made through it. By placing a website order or using our site, you agree to these terms. Please also read our Privacy Policy, Delivery Policy, and Refund Policy.

Smahchills Nigeria LTD is an Ekiti-based food company that produces and sells drinks, Greek yoghurt, and related products.

2. Acceptance of terms

By using our website, placing a website order, or interacting with our services, you confirm that you have read and agree to these Terms and Conditions and our related policies.

3. Eligibility

To place a website order you must provide accurate information. If you order on behalf of someone else, you confirm you have authority to do so.

4. Products and pricing

We sell drinks (including Zobo Mixed Fruit and Tigernut Drink), Greek yoghurt, and related products. We do not sell alcohol. Products are subject to availability. We may update or discontinue products without prior notice.

Prices are in Nigerian Naira (NGN). Price changes do not affect orders already paid and confirmed. Images are for illustration; slight packaging or colour differences may occur.

5. Website orders and payment

Choosing Delivery or In-Store Pickup at checkout and completing payment creates a website order. An order is confirmed only after payment is received and verified.

You agree to provide correct contact and fulfilment details. Payments are processed through the methods shown at checkout (including Paystack and bank transfer where enabled). Full payment is required before dispatch or hub collection. We do not offer cash on delivery.

Partner supermarket is not a website checkout. If you choose Partner Supermarket, you are directed to stockists listed on our site. You buy and pay at that supermarket. No online order, online payment, or online refund is created with SmahChills for that purchase. Supermarket prices, stock, and receipts are controlled by the retailer.

6. Fulfilment options

• Delivery: We deliver to addresses in our service areas. Fees and estimated times are shown at checkout for the option you select. You may be asked to choose a delivery date and time slot.
• In-Store Pickup (Ado-Ekiti hub): Free collection from our SmahChills store after online payment. You may be asked to choose a pickup date and time slot.
• Partner supermarket: Availability guidance only. Pay in store. See our Delivery Policy and Where to Buy page.

Full area, fee, and timing rules are in our Delivery Policy. Delivery times are estimates and may be affected by traffic, weather, courier capacity, order volume, or events outside our control.

7. Your delivery responsibilities

For website Delivery orders you are responsible for a correct address and phone number, being available for the selected slot (or clear alternative instructions), and checking the order on arrival.

8. Failed deliveries

If we cannot complete delivery because you are unreachable or the address/instructions cannot be used, we may attempt to contact you to reschedule. Re-delivery fees may apply. Refunds are generally not available where non-delivery is caused by incorrect details or customer unavailability. See our Refund Policy.

9. Order cancellation

You may request cancellation of a website order before dispatch by contacting us with your order details. Once dispatched, cancellation is usually not available. If cancelled before dispatch, we refund via the original payment method where possible.

Partner supermarket purchases cannot be cancelled through smahchills.com because no website order exists.

10. Refunds and returns

Our products are perishable. Change-of-mind refunds after delivery or hub pickup generally do not apply. Eligible cases (wrong item, damage, expiry at delivery, missing items, confirmed non-delivery after payment, payment errors) are described in our Refund Policy. Report issues as soon as possible, preferably within 24 hours of receipt, with your order number and photos where useful.

Refunds through SmahChills apply only to paid website orders. Issues with supermarket purchases should be raised with that supermarket (and you may also contact us for product quality feedback).

11. Product storage and handling

Refrigerate Greek yoghurt promptly (about 2°C to 6°C). Keep drinks chilled, shake well, and follow pack instructions. Smahchills is not responsible for quality loss caused by improper storage after you receive the products.

12. Intellectual property

Website content, branding, and packaging designs belong to Smahchills Nigeria LTD unless stated otherwise. You may not use them commercially without written consent.

13. Website use

You agree to provide accurate information, use the site lawfully, not place fraudulent orders, and not interfere with site security. We may refuse service or cancel orders if we suspect misuse.

14. Limitation of liability

To the fullest extent permitted by law, Smahchills Nigeria LTD is not liable for indirect or consequential losses arising from use of the website or products, including issues caused by failure to read ingredient labels. Our total liability for a claim is limited to the price paid for the product(s) concerned, except where law requires otherwise.

15. Third-party links and retailers

Our site may link to maps, payment pages, social platforms, or partner store information. We are not responsible for third-party sites or for a supermarket’s own checkout, stock levels, or pricing.

16. Changes

We may update these terms. Changes are posted on this page with a revised date. Continued use of the site after changes are posted means you accept the updated terms.

17. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Disputes are subject to the courts of Ekiti State, Nigeria.
